FCC Issues 600 MHz Consumer Disclosure

Washington, DC (July 27, 2017)—The Federal Communications Commission has issued an Order that provides the specific language for the Consumer Disclosure notice to be displayed on wireless mic products operating in the 600 MHz service band.

The Order, dated July 24, 2017, states: “This disclosure informs consumers that wireless microphone users must cease any wireless microphone operations in the 600 MHz service band no later than July 13, 2020. In addition, in many instances they may be required to cease use of these devices earlier if their use has the potential to cause harmful interference to 600 MHz service licensees’ wireless operations in the band.”

The disclosure requirement is applicable to “persons who manufacture, sell, lease, or offer for sale or lease, wireless microphone or video assist devices” capable of operating in the 600 MHz service band designated by the FCC’s recent Incentive Auction — 617-652 MHz and 663-698 MHz. The disclosure text must be prominently displayed on the product packaging and “the place or website where wireless microphones are displayed or offered for consumers to purchase or lease.”

While the FCC’s frequency spectrum repack plan is due to be completed by July 13, 2020, low power auxiliary stations (wireless microphones) or video-assist devices may need to vacate the 600 MHz service band sooner. The new licensees of the spectrum, including T-Mobile, Dish, Comcast and AT&T, may displace “protected” low power TV and translator stations with a written 120-day notification of intent to begin operations. T-Mobile is already sending notification letters and has stated that it intends to light up its new services — in as-yet undisclosed areas and frequencies — beginning in August.
